Jennifer A. Stiller has more than thirty years of experience in health
and hospital law, having concentrated her practice in that area since 1975.
In 1999, she was named one of the best lawyers in Philadelphia by Philadelphia
Magazine. In 2005, she was named to the inaugural class of AHLA
Fellows.
Her practice involves virtually every area of health law, including the Stark and Anti-Kickback Laws, compliance, HIPAA/HITECH, hospital-physician contracts, medical staff privileges disputes, physician employment contracts, licensure and certification, hospital and medical staff bylaws, consent to/refusal of treatment, managed care, and clinical research issues.
Ms. Stiller is particularly well known for her work in provider reimbursement and in structuring business deals to conform to the Stark and Anti-Kickback Laws, Medicare reimbursement regulations, and other governmental requirements. She frequently serves as a consultant to other health lawyers seeking advice on complex Stark/Anti-Kickback situations.
Her accomplishments include:
- Helping a major teaching hospital avoid regulatory shoals as it develops a system of community-wide, hospital-subsidized interactive electronic health records.
- Facilitating the implementation of a shared corporate compliance program for a group of otherwise unrelated religious-based nursing homes
- Advising hospital, nursing home, home health agency, and physician clients on compliance issues and negotiating settlements of compliance problems with governmental agencies
- Developing state-of-the-art conflict of interest policies to deal with the shifting allegiances in the contemporary healthcare market
In addition to her 2004 monograph, EMTALA: A Comprehensive Guide to the
Emergency Patient Screening and Transfer Law, Ms. Stiller is the author
of numerous publications on various aspects of healthcare law, including healthcare
privacy, provider reimbursement, corporate restructuring, hospital bankruptcy,
consent and refusal of treatment issues, and Medicare/Medicaid fraud and abuse.
She lectures frequently on health law topics, and was the principal author of
the "Financial Management" chapter
of Aspen Publishers' Hospital Law Manual. She served as Course
Planner for the Pennsylvania Bar Institute's 1992 Health Care Reimbursement
Institute and its 1993 course Ethics for Health Lawyers.
Prior to establishing The Law Offices of Jennifer A. Stiller in 2001, Ms.
Stiller spent nine years as chair of the Health Law Group at the Philadelphia
law firm of Montgomery, McCracken, Walker & Rhoads, LLP and then was
Senior Counsel at Tenet Healthcare Corporation.
She began her career in Pennsylvania state government, serving as a Deputy
Attorney General in the Attorney General's Office and the Department of
Health. Prior to entering private practice in 1983, she was also Manager
of the Department of Federal Law at the American Hospital Association.
Ms. Stiller graduated from the University of Michigan in 1970 with a double
major in economics and history. She received her J.D. degree from New York
University in 1973. She has served on both the Board of Directors and the
Executive Committee of the American Health Lawyers Association, the nation's
largest 501(c)(3) educational organization devoted to legal issues in the
healthcare field. She is a past President of the Pennsylvania Society of
Healthcare Attorneys and a former chair of the Health Law Committee of
the Business Law Section at the Philadelphia Bar Association. She is also
a member of American Bar Association's Health Law Section, the Healthcare
Financial Management Association and the Pennsylvania Bar Association's
Healthcare Law Committee. She is listed in several editions of Who's Who in America and Who's
Who in American Law.
Ms. Stiller is admitted to practice before the Supreme Court of Pennsylvania,
the United States Courts of Appeals for the Third and District of Columbia
Circuits, and the United States District Courts for the Eastern and Middle
Districts of Pennsylvania. She is
a qualified arbitrator and mediator on the panel of the American Health
Lawyers Association Alternative Dispute Resolution Service.
