The "HITECH" portion of the Health Information Technology portion of American Recovery and Reinvestment Act of 2009 has added numerous requirements to those already imposed by the HIPAA Privacy and Security Regulations. Enforcement initiatives have been expanded, and civil monetary penalties have been substantially increased. There are new obligations for public notification of security breaches, and patients are gaining new rights to their health information. Effective February 17, 2010, business associates will, for the first time, be directly responsible to the federal government for compliance with the Security Regulations and certain privacy requirements.
